Situation
last modified: Wednesday, February 06, 2008 (7:44:34 PM)
Had a situation come up that I'm not happy about. I sold a cel a couple of months ago, okay, nothing unusual. A friend I hadn't spoken to in a while sent me the sketch for the cel after the fact thinking I still had it. Since I don't have the cel I really don't have any use for the sketch so I put it up on ebay. Then I get this email from the person who bought the cel saying that I had misled them. Mind you, there was no mention of the sketch in any of my communications with this person. They are now demanding that I either send them the sketch free of charge or their money back. I have NEVER misled anyone on a sale. EVER. I have all the emails sent back and forth, I checked them over very carefully just in case I missed something but there was never any mention of the sketch since I didn't have it at that time. I think this person is just wanting something for nothing but I also know that if I get blasted on the boards I'll never be able to sell anything again. It's just a mess. Anyone have any suggestions?

Sounds like a situation I had to deal with a few weeks ago.

Make sure you keep all communication in the event they file with Paypal for their money back. Paypal will likely ask you to forward all communication to them. If you have your old listing of that cel, you may also want to keep that as well as any scans made of the item prior to shipping. I was fortunate enough to know that the buyer that recently attempted this stunt was shady and I took up close pictures of each of the items I sent. Because of that, I was able to receive the entire payment back.

If I was you, I would NOT send them the sketch. The person has been rude to you and sounds like an SOB. You did not mislead them, and they have to learn to not bully people into them getting their way. Since you did nothing wrong, I would not worry. -Wish you the best!!!

If the sketch wasn''t mentioned/included in the auction description, then they have no right to demand anything from you. Your auction was for the cel, and that''s what they purchased. Stand firm.

I concur with my fellow RS members. Don''t give in. The person is trying to force your hand to give them something for free. The thing is, if you realize they have nothing to hold against you (in that you have only mentioned in the ebay auction the sale of the cel and not the sketch) then they have no grounds for demanding the sketch. Dont worry about the public outlash because if you have all the evidence (aka the emails and such) the individal has no real ground for them to use against you if you per say made a post about the bad deal. There are some people out there that attempt to scam good hearted indvidiuals simply because alot of individuals in this collecting scene are to "nice" aka guilible and these individuals feed on that. Like i said, dont give him anything, forward all emails (if needed) to paypal, and for the overwhelming idiots (sadly) that are collecting, I suggest in future auctions at the bottom you Bold, Red Font + larger then normal stating that "This cel does NOT come with a sketch" for further emphasise (or in some type of fashion). That way in case of disagrement you could simply show paypal the auction page and it would be over with much faster.
